CFTC Opens Consultation on Regulation of Certain Retail Crypto Transactions
The U.S. CFTC has issued an advance request for comments on possible rules for certain retail commodity transactions involving crypto assets. These are not yet final rules or immediate new requirements.

On October 5, 2026, the U.S. Commodity Futures Trading Commission (CFTC) announced the launch of a public consultation on CFTC retail crypto transactions. It published an Advanced Notice of Proposed Rulemaking (ANPRM), an advance request for information ahead of a possible rule proposal.
The consultation concerns retail commodity transactions involving crypto assets under Section 2(c)(2)(D) of the Commodity Exchange Act. The regulator refers to them as CTXs. These are not approved final rules, and the notice itself does not introduce an immediate new requirement for the crypto market as a whole.
CFTC consultation on retail crypto transactions
The CFTC is requesting public comments in several areas. It is particularly interested in preventing market abuse, interpreting existing requirements in a crypto-specific context, and the possibility of creating a separate registration subcategory for a designated contract market (DCM).
This possible subcategory would be called “crypto asset market.” However, the notice does not define its final form or the specific obligations that would apply to entities registered in this way. At this stage, the CFTC is asking the public for comments.
An ANPRM is an early step in the U.S. regulatory process. Unlike a formal proposed rule, it does not yet present the final text of binding requirements. Its purpose is to identify issues, gather feedback, and assess possible approaches before the regulator potentially prepares a specific proposal.
Comment period will begin after publication
The CFTC stated that the comment period will last 60 days from publication of the ANPRM in the Federal Register, the official journal of the U.S. federal government. The exact deadline has therefore not yet been confirmed.
Publication of the document itself in the Federal Register, as well as the docket number available through the Regulations.gov portal, will be important for the next steps. Public comments may indicate which issues market participants consider important in defining CTXs and a possible registration framework.
What this step does not change for now
The notice does not mean that the CFTC has already adopted a new federal framework for cryptocurrency exchanges, intermediaries, or individual tokens. The available information does not indicate what specific binding rules the commission might propose or adopt after the consultation ends.
The scope of the impact on individual platforms and products has likewise not been confirmed. It can be assessed only on the basis of any subsequent proposal, the precise definition of CTXs, and the final wording of the rules.
For the market, the key point is that the CFTC has formally opened a process for gathering information on possible rules in the retail crypto transactions segment. The next step to watch will be the content of the ANPRM in the Federal Register and the commission’s decision on whether to prepare a specific regulatory proposal after reviewing the comments.
